You are right, "auto add" is in fact the wrong terminology. We will update our content to be less irritating.
The checkbox is unchecked because it's part of the MailChimp Terms of service and CAN-SPAM laws that you are only allowed to send newsletter campaigns to people "who specifically requested email from you". If the checkbox is checked by default it wouldn't comply with these terms and we certainly don't want you to get into trouble

As soon as someone registers on a joomla site, he automatically agrees to receive email from you. Even when no boxes are checked.
And here's my proof: the first email he will receive from the site is email to confirm the registration
so in my view, there is no problem to auto add the user to mailchimp

I am sorry to disappoint you, but that is not "proof" that someone agrees to receive your marketing newsletters. Unless they specifically agree to your terms of service which include a clause about receiving email marketing or specifically agree to receiving your newsletter by checking a box. We try to implement best-practices for our users to avoid coming into conflict with tight regulations set by Mailchimp and their TOS. See for example:

Remove any prospects or leads who did not explicitly request email marketing from you or otherwise meet the requirements of 11(b) above. Even if you're sending email marketing to customers who have consented to receive your Email, you are still required, under applicable law, to allow them to opt-out of your email marketing list (you may need to turn that feature ON in your CRM tool). The simple fact that a recipient is "in my CRM" is not the same as "they gave us permission to send them email marketing."
If nonetheless you do feel like you have permission from all your new signups and are willing to jeopardize your Mailchimp account you can use a plugin like:
